Bates International - Las Vegas Information

In 1973, Bill and Sandra Bate purchased an RV for their personal use. Sandra soon tired, however, of owning a vehicle that sat and collected parking tickets 90% of the time. She placed a classified ad in the Los Angeles Times, hoping someone would want to rent the vehicle, so it wouldn't just sit in front of her house. Sandra recognized the overwhelming response she received as a business opportunity. She contacted other RV owners, offering to rent their units for them, and the Bates Motor Home Rental Network was born.

Today, the Bates Franchise System (Bates) is the result of nearly thirty years of development by a staff that represents almost a century's worth of RV travel management and business experience. Bates International - Las Vegas Rental Terms for travel between 01-Jan-2008 and 31-Dec-2009

1. Lessor (Owner) has employed AGENT, an independently owned and operated licensee of the Bates Motor Home Rental Network, in its dealings with Lessee (Renter) in the negotiation of and in respect to the performance of this rental agreement. AGENT is hereby authorized on behalf of Owner to do all acts necessary and proper to represent Owner in its dealings with Renter, including the collection and remittance of monies on Owner's behalf, the issuance of receipts for monies received on behalf of Owner, and for its delivery of the motor home rented hereby.

2. The acceptance by Renter of the delivery of the motor home rented shall constitute his acknowledgment and admission that he has carefully examined it and all additional equipment and has received the same in good condition. Renter agrees to examine the motor home at reasonable periodic intervals, including it tires, and to maintain it in substantially the same condition in which it was delivered. The rental of the motor home includes all of the additional equipment, utensils and furnishings which shall be set forth and listed on an addenda to be executed by the parties hereto prior to departure and shall be without additional charge unless otherwise expressly provided for in the addenda.

3. Renter agrees to pay to supplier a security deductible in the amount set, prior to the departure date as stated in this rental agreement. Deductible (less the deduction of any charges authorized hereby, which amounts Bates is authorized to retain) shall be refunded to Renter, provided Renter is not in default of the terms, covenants and conditions of this rental agreement.

4.   In the event the number of miles/kilometers traveled by the motor home during the time the Renter has possession exceeds the estimated mileage/kilometers, then the Renter agrees to pay, upon the return of the motor home, a mileage/kilometers charge equal to that excess and AGENT is hereby authorized to retain out of the Renter's deductible the charge per mile/kilometer for excess mileage/kilometers traveled.

5.  Renter shall pay to AGENT the following: (a) Mileage/Kilometers charge computed at the rates shown in this agreement (mileage/kilometers to be determined by reading factory installed odometer). This applies to miles/kilometers traveled or estimated in the agreement. (b) Basic service, and other charges when applicable to the rental. (c) Refill of fuel and propane tanks to the same level as when vehicle was accepted. (d) Charges for extraordinary cleaning will be assessed for excessive grime to interior and/or exterior of motor home. (e) Charges if Renter abandons motor home. (f) Charges for repair or replacement of damaged or lost equipment or supplies not otherwise covered in agreement. Applicable sales, use or other excise taxes and amounts charged by AGENT as reimbursed for taxes paid. (g) AGENT'S cost, including reasonable attorney fees, and/or fees incurred in collecting payment due from Renter under this agreement. (h) Fines, penalties, forfeitures, or other expenses, if assessed against AGENT under compulsion of law, with respect to use of vehicle while in rental to Renter, unless due to AGENT'S fault, but this shall not relieve Renter or any other person of direct responsibility to any federal, state or municipal body of his own conduct. Renter agrees that AGENT may apply the advance charges or the security deductible or any part thereof as a credit to any amount due AGENT..

6. AGENT rents to Renter and Renter rents from AGENT the motor home described herein and the additional equipment as stated and subject to the listed terms and conditions. This rental agreement shall commence on the pick-up date/time and shall terminate on the return date/time. The motor home remains subject to the terms and conditions of this agreement until AGENT inspects and accepts it. If Renter returns motor home after hours, Renter is still responsible for any damage to the vehicle, until AGENT inspects and accepts it the next business day. Any requests for changes in the rental agreement must be in writing, must be approved by AGENT, and must be submitted at least twenty-four (24) hours in advance.

7.  No person shall drive the motor home during the term of this rental agreement or while said motor home is in the possession of Renter, except for the authorized drivers whose names are listed. Renter covenants that he shall permit no person other than such authorized drivers to drive said vehicle. Renter hereby represents that each of the authorized drivers, including Renter, has a currently valid driver's license and is in excess of twenty-five (25) years of age.

8.   Renter shall maintain the motor home in strict compliance with the manufacturer's maintenance procedure and in accordance with AGENT'S instructions, which may be given to Renter. Renter shall pay AGENT the value of any equipment, utensils and furnishings, which are lost, stolen, destroyed or damaged during the term of this agreement.

9.   If the motor home is not returned on the date specified, to the place specified, or such a place agreed upon between AGENT and Renter; Renter shall pay upon AGENT'S demand, in addition to all other sums payable and all other liabilities incurred, a full day's charge for the motor home for each day or fraction thereof, plus thirty (30) cents per mile, until the motor home is returned to the specified place.

10. No credit or refund shall be given to the Renter if the motor home is returned prior to the contracted date. In such event Renter shall be liable for all charges as if the motor home was returned on the scheduled date.

11.   Renter agrees to keep vehicle and it's components serviced and agrees to pay upon demand for loss and expense, repairs, parts, or supplies due to neglect, abuse or misuse of vehicle (including without limitations, lack of proper repairs, and failure to add oil, antifreeze, water, air or other expendables necessary for the proper and safe operation of the vehicle during period of rental). Rates do not include gasoline.

12.  Renter shall pay for all fuel and oil, and shall not be entitled to any reimbursement thereof. AGENT shall reimburse Renter for necessary repairs to the motor home during the term of this agreement, which are required by any breakdown or damages not caused directly by the misuse, carelessness or negligence of the Renter, provided all such repairs are fully documented with work orders, invoices and receipts. No credit will be given for replacement parts unless they are returned to AGENT. AGENT shall not be responsible for time loss (except to AGENT as provided herein), or any other incidental expenses.

13.   Renter agrees to contact AGENT, by telephone for motor home repairs in excess of $100.00 to obtain authorization at an authorized repair center. Such authorization for repairs shall not constitute a waiver of any right to charge Renter for such repairs, if, in the opinion of AGENT, such repairs were required because of the misuse, carelessness or negligence of Renter, or Renter's failure to comply with the terms of the agreement, or with the maintenance instruction given to Renter. Renter shall not permit any lien to be placed upon the unit.

14.   AGENT reserves the right to substitute another motor home should the original contracted for become unavailable and supply one that may be different from that ordered or from the vehicle pictured in brochures. Every effort will be made in such cases to supply a comparable unit. Rate will be adjusted consistent with the type of vehicle supplied.

15.   In the event AGENT is unable to make motor home available to Renter for the term of this agreement, all payments made by Renter for this rental shall be refunded, but AGENT, and AGENT'S agent shall in no event have liability beyond said refund.

16.   Reservations made within 30 days require full payment immediately. Renter shall make payment in the form of a cashier's check, money order, or cash. Payments from Renters for the United States must be paid in U.S. funds and for Canada must be paid in Canadian funds. (American Express Travelers Checks and Bank Wires are acceptable). No draft or checks on foreign banks will be honored. All sums of money due under this Rental agreement shall be payable to AGENT, at its address.

17.   All cancellations must be in writing.  The booking deposit payable upon booking confirmation is non refundable. Cancellations may also be subject to an additional $100.00 minimum-processing fee. Cancellations within 60 days prior to departure are subject to a further $250.00 fee. If cancellations are made within 14 days of departure date (commencement of rental) then all monies collected are non-refundable, however all monies apart from the non refundable booking deposit may be applied within one year toward a future rental.

18.   RENTER IS RESPONSIBLE FOR THE MOTOR HOME AND DAMAGE TO THE MOTOR HOME, INCLUDING LOSS OF USE.

19.   INSURANCE: RENTER AGREES TO MAINTAIN AUTOMOBILE INSURANCE during the term of this rental agreement, providing the Owner, the renter, and any other person using or operating the rental vehicle with the following primary coverage: (a) Bodily injury and property damage liability coverage; (b) Personal injury protection, no-fault, or similar coverage where required; (c) Underinsured coverage where required, and (d) Comprehensive and collision damage coverage extending to the rental vehicle. Customer's insurance will provide at least the minimum limits of coverage required by the financial responsibility laws of the state where the loss occurs. Because the customer is providing automobile insurance, AGENT'S insurer is not. In states where the law requires AGENT'S insurer to provide insurance, AGENT'S insurer will provide excess insurance only, up to the minimum limits required by the financial responsibility laws. The renter's insurance will be primary. Any insurance AGENT'S insurer is required to provide applies to claims of bodily injury and property damage only. AGENT insurer's policy contains exclusions, conditions, and limitations applicable to anyone claiming coverage. Renter agrees to cooperate with AGENT'S insurer if any claim is made. AGENT'S insurer's insurance applies only in the United States, and Canada. Renter must obtain written permission, and purchase special liability insurance, to use or operate the rental vehicle in Mexico. Where permitted by law, renter rejects uninsured, under insured, supplemental, personal injury protection, and no-fault coverage. Where AGENT'S insurer is required to provide such coverage, renter is afforded the minimum limits required by law. Any breach of any part of this agreement will void any insurance coverage.

20.   The following list are prohibited uses and will violate the agreement, void liability coverage, and the Renter will be responsible for all damage to the rental vehicle as a result of: (1) collision with the structure of any underpass or other object because of insufficient clearance whether height or width. (2) Using vehicle on any road or other areas that is not hard surfaced and regularly maintained resulting in undercarriage damage, including tires and wheels. (3) Improperly loading and securing contents, including doorsteps when not properly stowed. (4) Allowing a greater number of persons to occupy vehicle than originally indicated on the agreement. (5) Using the vehicle in any race, test or contest. (6) Operating the vehicle in connection with or during any periods of riots, strikes or civil commotion. (7) To carry persons or property for hire. (8) To propel or tow vehicles or other objects. (9) If vehicle is obtained from AGENT or Agent by fraud or misrepresentation. (10) If the vehicle is driven by any person while under influence of intoxicants or used for any illegal purpose.

21.   AGENT shall not be liable for any damage to property or injury to persons (including death) resulting from the use, operation or possession of the motor home by Renter, and shall indemnify and save AGENT harmless from all such liabilities.

22.   Renter agrees to report any accident involving the motor home to AGENT immediately after its occurrence. In case of an accident, a police report must be submitted to AGENT within 24 hours. In addition, Renter agrees to deliver to AGENT as soon as possible, every process, pleading or paper of any kind relating to any and all claims, suits and proceedings received by Renter or any driver or passenger of the motor home, and relating to the use of said motor home. None of the drivers or passengers shall in any manner aid or abet any claimant, but shall cooperate fully with AGENT in all matters connected with the investigation and defense of any claims or suits.

23.   Renter shall be solely responsible for and will hold AGENT harmless from any and all fines, forfeitures or penalties arising out of the violation of any law while a motor is in possession of Renter or Renter's agents hereunder, and shall reimburse AGENT for the loss or confiscation of the motor home.

24.   Theft, vandalism, and breakdowns: Renter shall assume responsibility for theft and vandalism of and to the vehicle and other equipment. They shall indemnify and hold AGENT harmless from all loss resulting there from; and shall assume liability for any and all damage or loss to property transported in said vehicle, including damages or loss caused by fire, water, theft, vandalism, or collision. Renter assumes full responsibility for any additional expenses incurred by reason of a breakdown of vehicle whether or not causing a delay en route. AGENT'S maximum liability shall be for refund of daily rental rate as a result of breakdown, which requires vehicle to be in repair for more than 12 hours. This liability not to exceed the period of the Rental Agreement. Microwave, radio, television malfunctions or lost reception on radio or television are not considered a mechanical breakdown.

25.   The relationship between the parties to this agreement is that of AGENT and Renter. Renter is not and shall not hold themselves to be an agent or employee of AGENT, or in any other capacity than Renter. Renter shall have no authority to represent or make any commitment binding upon AGENT.

26.   Renter shall not assign this rental agreement or subject the motor home rented hereby without prior written consent of AGENT.

27.   In the event of a breach of any of the terms and conditions of this rental agreement by Renter, AGENT may, without prior demand, take possession of the motor home by entry upon Renter's premise, if necessary, with or without process of law. In the event of any such breach, Renter shall be liable for any and all expenses incurred by AGENT in repossessing the motor home or collecting any charges agreed to be paid, including reasonable attorney's fees and court costs. In addition, Renter shall be liable for all damages suffered by AGENT as a result as of Renter's breach of this agreement.

28.   Any waiver by AGENT of any terms, conditions or provisions of this rental agreement shall not constitute a continuing waiver nor shall it be a waiver of or consent to any succeeding breach of the same or any other provision hereof.

29.   The remedies granted to AGENT are cumulative, and are in addition to, and not limitation of, any other remedies available to AGENT by law, and AGENT, by pursing any or all of the remedies provided herein or by law, shall not be deemed to have waived any other available remedy.

30.   Upon return of the motor home, Renter agrees to fill its fuel and propane tanks, empty toilet and holding tanks, or pay an amount determined in the sole discretion of AGENT for refilling fuel and propane tanks and emptying said facilities, which charge shall not be unreasonable. Renter further agrees for cleaning the same, in such case, the cleaning fee shall be as expressed unless clean-up requires more than ordinary service, in which case Renter agrees to pay for all extraordinary charges in excess of the agreed clean-up fees.

31.   Where the content so requires, the use of the singular shall be deemed to include the plural; the use of the plural shall be deemed to include the singular; the use of the masculine gender shall be deemed to include the feminine or neuter gender.

32.   The provisions of this Rental Agreement shall be construed in accordance with the laws of the State, county, or province the vehicle was rented.

33. Vehicle Restrictions: Divers must be at least 25 years old and present a valid drivers license upon vehicle pick-up. There are no additional drivers fees subject to this branch

Pets: Prior arrangements must be made with Bates International prior to travel. It will be up to the suppliers discretion. Failure to do so will mean $500.00 will be charged against the customers security deductible.

Smoking :Under no circumstances can smoking occur in the vehicle. If evidence of smoking is found - a $500.00 fine will be charged against the customers security deductible.

Area restrictions: Under no circumstances can Bates International units travel to the Burning Man festival between August 23 - September 5. Vehicles can not be driven into Mexico.

Time restrictions
Bates do not recommend that customers travel into Alaska during the Winter months.

The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.


Bates International - Las Vegas Insurance

Customers are asked to purchase excess reduction options in addition to their rental . International customers will need to purchase one of the suppliers own insurance options otherwise domestic customers can either purchase the suppliers own insurance or provide a binder from their own carrier within two days of the hire commencing.

The following bonds will apply: $500 for smaller units / $1000 for larger units - to reduce the excess customers can pay the following charges:  For size 22'-29'-  $15 daily, 30'-35' - $20 daily, 36'-42- - $25 daily.

None of the drivers or passengers shall in any manner aid or abet any claimant, but shall cooperate fully with AGENT in all matters connected with the investigation and defense of any claims or suits.

Renter shall be solely responsible for and will hold AGENT harmless from any and all fines, forfeitures or penalties arising out of the violation of any law while a motor is in possession of Renter or Renter’s agents hereunder, and shall reimburse AGENT for the loss or confiscation of the motor home.

Theft, vandalism, and breakdowns: Renter shall assume responsibility for theft and vandalism of and to the vehicle and other equipment. They shall indemnify and hold AGENT harmless from all loss resulting there from; and shall assume liability for any and all damage or loss to property transported in said vehicle, including damages or loss caused by fire, water, theft, vandalism, or collision. Renter assumes full responsibility for any additional expenses incurred by reason of a breakdown of vehicle whether or not causing a delay en route. AGENT’S maximum liability shall be for refund of daily rental rate as a result of breakdown, which requires vehicle to be in repair for more than 12 hours. This liability not to exceed the period of the Rental Agreement.   Microwave, radio, television malfunctions or lost reception on radio or television are not considered a mechanical breakdown

All pick ups and drop offs in Winter months must be made between 9 a.m. - 5 p.m. Mon to Fri. No after-hours pick-ups nor drop-offs will be available.

All pick ups and drop offs in Summer months must be made between 8 a.m. - 7 p.m. Mon to Fri by appointment only. No after-hours pick-ups nor drop-offs will be available.

Customers can make their own way to and from the Bates depot or we offer a return shuttle service from Las Vegas Airport for $20pp for groups of 4 passengers or less - further details regarding this service are provided upon confirmation.
